Terms of Service and Privacy Policy

1. Introduction

Welcome to FBM AI Reply ("we", "us", "our"). These Terms of Service and Privacy Policy ("Terms") govern your use of our website at fbmaireply.com, our dashboard, and our browser extension (together, the "Service").

By creating an account, installing our extension, or using the Service in any way, you agree to these Terms. If you do not agree, please do not use the Service.

2. The Service

FBM AI Reply is a tool that helps Facebook Marketplace sellers respond to buyer messages more efficiently using artificial intelligence. The Service consists of a web dashboard where you manage your account, settings, and listings, and a browser extension that assists in drafting and sending replies to messages on Facebook Marketplace.

The extension reads the content of conversations you have on Facebook Marketplace in order to generate relevant replies. It operates only while you have it enabled and only on Facebook pages.

We are an independent product. We are not affiliated with, endorsed by, or sponsored by Facebook, Meta Platforms, Inc., or any of their subsidiaries.

3. Accounts & Eligibility

You must be at least 18 years old and able to form a legally binding contract to use the Service. You are responsible for maintaining the confidentiality of your account credentials and your unique key, and for all activity that occurs under your account.

You agree to provide accurate information when creating your account and to keep it up to date. You must notify us promptly of any unauthorized use of your account.

4. Acceptable Use

You agree to use the Service in compliance with all applicable laws and with the terms and policies of any third-party platform you use it with, including Facebook's terms of service.

You are solely responsible for how you use the Service and for the messages sent through your account. You agree not to use the Service to send spam, harassment, deceptive, fraudulent, or unlawful content, or in any way that could harm others or violate their rights.

Automating interactions on third-party platforms may be restricted by those platforms. You acknowledge that you use the Service at your own risk and that you are responsible for ensuring your use complies with Facebook's policies.

5. Plans & Payments

The Service offers a free plan and paid subscription plans (Starter, Pro, and Agency) with different monthly reply limits and features. Paid plans are billed on a recurring basis until cancelled.

Prices are shown on our billing page and may change with notice. You can upgrade, downgrade, or cancel your subscription at any time from your dashboard. Unless required by law, payments are non-refundable for partial billing periods.

6. Intellectual Property

All rights, title, and interest in the Service, including its software, design, and branding, belong to us. We grant you a limited, non-exclusive, non-transferable license to use the Service for its intended purpose while your account is active.

You retain ownership of your own content, including your listings and the messages you send. You grant us permission to process this content solely to provide and improve the Service.

7. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied. We do not guarantee that AI-generated replies will be accurate, appropriate, or suitable for every situation, and you are responsible for reviewing messages sent through your account.

We do not guarantee that the Service will be uninterrupted, error-free, or compatible with future changes made by Facebook or other third parties.

8. Limitation of Liability

To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, accounts, or business, arising from your use of the Service.

Our total liability for any claim relating to the Service will not exceed the amount you paid us in the twelve months before the claim arose.

9. Privacy Policy

This Privacy Policy explains what information we collect, how we use it, and the choices you have. We take your privacy seriously and only collect what we need to provide the Service.

10. Data We Collect

Account information: your name, email address, and securely hashed password when you register.

Usage data: the number of replies you generate, timestamps, and the language of replies, used to enforce plan limits and show your dashboard statistics.

Listings data: the Facebook Marketplace conversation links and any listing details or prices you choose to save.

Message content: when the extension is active, it reads the text of the Marketplace conversation you are viewing in order to generate a reply. This content is sent to our AI provider to produce the reply and is not stored long-term beyond what is needed to operate the Service.

We do not collect your Facebook password and we never log in to Facebook on your behalf. The extension works within your own logged-in browser session.

11. How We Use Data

We use your data to operate the Service: to authenticate you, generate replies, enforce plan limits, display your statistics, and provide support. We use aggregated, non-identifying usage data to improve the Service.

We do not sell your personal data to anyone.

12. Data Sharing

We share data only with service providers that help us run the Service, under agreements that protect your data. These include our hosting and database provider, and our AI provider (OpenAI) which processes message content to generate replies.

We may disclose information if required by law, to protect our rights, or to prevent fraud or abuse.

13. Data Retention

We keep your account and listings data for as long as your account is active. Reply history is retained according to your plan (from a few days on the free plan up to full history on higher plans). You can delete your listings at any time, and you can request deletion of your account by contacting us.

14. Your Rights

Depending on your location, you may have the right to access, correct, export, or delete your personal data, and to object to or restrict certain processing. You can manage much of your information directly from your dashboard, or contact us to exercise these rights.

15. Cookies & Local Storage

We use essential cookies and browser local storage to keep you signed in, remember your language preference, and operate the Service. We do not use advertising cookies.

16. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will update the date at the top of this page and, where appropriate, notify you. Your continued use of the Service after changes take effect means you accept the updated Terms.
